This Privacy Policy describes how Q23 co., ltd., doing business as Ohana bjj (“Ohana bjj", ”we", "us”, or "our") collects, uses, and shares your personal information when you visit OhanaBJJBangkok.com (the "Site"), purchase products from us, book a trial class, sign up for an academy membership, or otherwise interact with us. It also explains the choices you have about your information.
1. INFORMATION WE COLLECT
Information you give us. When you place an order, book a trial class, request membership information, create an account, contact us, or sign up for emails or texts, we collect the information you provide, such as your name, email address, phone number, billing and shipping address, payment information, and the content of your messages. Payment card details are processed by our payment processors and are not stored by us.
Information about students. When you enroll yourself or a child in an academy program, we collect the information needed to deliver that program, such as the student's name, date of birth, emergency contact details, and relevant health or injury information you choose to share. This information is collected through our membership platform and the membership agreement, and is used only to operate the academy.
Information collected automatically. When you visit the Site, we and our service providers automatically collect information about your device and how you interact with the Site, including IP address, browser type, time zone, referring pages, pages viewed, products viewed, search terms, and approximate location. This is collected using cookies, pixels, tags, and similar technologies (see "Cookies and Tracking" below).
2. HOW WE USE YOUR INFORMATION
We use personal information to: provide, fulfill, and ship orders and send order confirmations; schedule and deliver trial classes, memberships, and academy programs; process payments and screen orders for fraud; respond to your questions and provide customer support; send you marketing emails and text messages about products, programs, and events, where permitted by law and in line with your preferences; understand how the Site is used so we can improve it; measure and improve the performance of our advertising; and comply with legal obligations and protect our rights.
3. HOW WE SHARE YOUR INFORMATION
We share personal information with service providers who help us run our business, and only for the purposes described above. These currently include:
Squarespace – hosts our online store and processes orders and payments. Squarespace’s privacy policy: https://www.shopify.com/legal/privacy
Google (Google Analytics, Google Ads, Google Maps) – site analytics, advertising measurement, and maps
Meta (Facebook and Instagram pixel) – advertising measurement and audience building
TikTok (pixel) – advertising measurement
YouTube – embedded videos
Shipping carriers, payment processors, and fraud-prevention services
We may also share personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request, to protect our rights, or in connection with a merger, sale, or reorganization of our business.
We do not sell personal information for money. However, some of the advertising and analytics tools above receive information about your activity on the Site through cookies and pixels, which may be considered a "sale" or "sharing" of personal information under Thai law.
4. COOKIES AND TRACKING
A cookie is a small file placed on your device when you visit a website. We use cookies and similar technologies that are: (a) necessary for the Site to work, such as keeping items in your cart and keeping you logged in; (b) analytics cookies that tell us how visitors use the Site (Google Analytics, Shopify analytics); and (c) advertising cookies and pixels that help us measure and personalize ads (Google Ads, Meta pixel, TikTok pixel).
Because there is no consistent industry standard for "Do Not Track" browser signals, we do not respond to them. We do honor Global Privacy Control (GPC) signals as an opt-out of sale or sharing where required by law.
5. CHILDREN
Our academy offers programs for under-20s, and parents or guardians may enroll a child and provide the child's information for that purpose. The Site itself is intended for use by adults, and we do not knowingly collect personal information directly from children under 13 online. If you believe a child has provided us with personal information without a parent's or guardian's involvement, please contact us and we will delete it.
6. MARKETING COMMUNICATIONS
You can unsubscribe from marketing emails at any time by using the unsubscribe link in any email. Even if you opt out of marketing, we may still send you non-promotional messages about your orders, membership, or account.
7. RETENTION
We keep personal information for as long as needed to provide our services, maintain business and legal records, resolve disputes, and enforce our agreements. Order and membership records are kept for as long as required by tax and accounting laws. You can ask us to delete your information as described below.
8. YOUR PRIVACY RIGHTS
8.1 Thailand. We collect, use and disclose your personal data in accordance with the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”). We process your personal data on the following lawful bases: to perform our contract with you; with your consent (for example, for marketing and non-essential cookies); to comply with our legal obligations; and for our legitimate interests in running and improving our business, where those interests are not overridden by your fundamental rights. Under the PDPA you have the right to: access and obtain a copy of your personal data; request correction of inaccurate data; request deletion or anonymization of your data; request data portability; object to or request restriction of our processing; and withdraw consent at any time (withdrawal does not affect processing carried out before withdrawal). To exercise these rights, contact us using the details below. We will respond within 30 days of receiving your request. You also have the right to lodge a complaint with the Personal Data Protection Committee (PDPC) of Thailand.
9. SECURITY
We use reasonable technical and organizational measures to protect personal information, including encrypted connections and reputable payment processors. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
10. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The date at the top shows when it was last revised. Continued use of the Site after changes are posted means you accept the updated policy.
